我之前发过帖子询问关于lg的O1的事。大家都告诉我一旦辞职就没有grace period，但当时因为和欧洲一家公司已经达成协议，马上就办签证，所以当时就想着在美国再呆2个月等签证办下来就离开美国。但因为欧洲那家公司突然毁约，导致我们现在很被动。这时SF一家公司给了Offer,愿意transfer O1,然后对方打电话询问现在的status之后，说我们现在已经是非法滞留了，真的要办估计要出境办。我有几个问题请教各位前辈：1 出境的意思是回中国还是可以去通过申请旅游签证去加拿大或墨西哥办？2 如果出境办，我们滞留的这几个月是不是对申请签证很不利？（我真的很无奈滞留这两个字）3 如果可以去加拿大或墨西哥申请，一般需要多长时间？很急，谢谢大家的帮助了。

1) O-1 visa is not like H-1B visa, it can not be transferred;2) The second O-1 visa will be a new application;3) You could apply for the O-1 inside the USA, however, if you are already out of the status, then you could not change your nonimmigration status or visa inside the USA;4) After you get the Approval Notice of your O-1 case, you must return to China to get O-1 visa, not 3rd country.5) Due to your invalid status inside the USA (2 months), you must prepare to explain this in China--must have a very good reason.
