前几天向香港这次起诉的律师咨询了一些事，得知目前还可加入，但是律师觉得上次50人准备参加，后来只来了15人觉得“受骗了”，我向他解释了我们缺乏信息等原因，ruth让我问他如果人数多是否还能降低费用，准备等问清楚就上来告诉大家，刚刚看到他的回信。对于费用讲得比较清楚，前面的通信也会继续贴出。 [FONT=宋体]Dear XXX, [/FONT]​[FONT=宋体]Before telling me that, by lowering my fee, I would have 50 participants, 50 people in the group should already have agreed to those terms. To be sure, I presumed that they had. That was my mistake. However, needless to say, it did not leave a good taste in my mouth.[/FONT]​[FONT=宋体] [/FONT]​[FONT=宋体]At this point, over 470 have joined the litigation. I have provided you proof that the litigation is before the Court and all those who trusted me enough to pay have been able to check from the Federal Court's website that they have an case in the Court. Therefore, there is absolutely no justification for doubting that this litigation exists or that I am not pursuing this matter on behalf of those who have placed their trust in me.[/FONT]​[FONT=宋体] [/FONT]​[FONT=宋体]If CIC agrees to mediate the issue, which is to say, if it accepts that settlement is better than litigating, I will be raising the fee because there should be little doubt but that we will be successful. CIC is to tell the Court by December 20th whether it will agree to mediation.[/FONT]​[FONT=宋体] [/FONT]​[FONT=宋体] My standard fee applies to everyone , which is $550 now and, if successful, an additional $500. The fee will increase to $750 initially and $1,000 upon success for those who join either after CIC agrees to mediate or after December 31st, whichever event first occurs. And, if we settle, it will apply only to those who are participating in the litigation and there will be no court decision on which others may rely to secure the same result.[/FONT]​[FONT=宋体] [/FONT]​[FONT=宋体]I long ago reach the numbers I needed to get the Court's and CIC's attention. However, I would like to see more Chinese in the group because I do not want it to look as though it is only a problem for Indians and Iranians. However, if Chinese are not interested in joining, there is nothing I can do. For me, it is only a little bit of money; for the applicants, it is their future. So, while I would very much like more Chinese participation, I will soon be moving to the point of preparing the written arguments. [/FONT]​

Initially my idea was to charge only a little in order to know whether a person was committed to the litigation and, once I reached 100 litigants, I would initiate the litigation, which I did on October 28th. At this point, we have 476 litigants. So, it is the full amount.[FONT=宋体] [/FONT]​[FONT=宋体] [/FONT]​In addition, I lowered the fee for your group because I was promised that, if I did, at least 50 would sign on, but only 15 did. Needless to say, I felt that I had been conned. At this juncture, if Immigration (CIC) agrees to the Court's suggestion that it mediate, as opposed to litigate, the matter, I will be raising fees over all because, by agreeing the negotiate, CIC is effectively agreeing that it will fashion some solution for the litigants. CIC's decision is due December 20th.​​

However, the Court has directed that all these cases proceed together. We will either begin with mediation or with representative applications. CIC is to advise the Court by December 20th whether it will accept the Court's offer to have a junior judge try to negotiate a settlement between the parties. [/FONT]​[FONT=宋体] [/FONT]​[FONT=宋体]If CIC refuses to negotiate, we litigate. If so, I will select one case to represent a group of cases and those cases will proceed first. The decision on those cases will then be applied to the others. It appears that both parties are agreed that we have two classes of litigants; viz., those who applied before 27 February 2008 and those who applied between 27 February 2008 and 26 June 2010; and various visa-posts. Therefore, I will select one case from each class and from each visa-post and proceed from there. Hopefully CIC will agree to this approach.[/FONT]​[FONT=宋体] [/FONT][FONT=宋体]2. I have sent you the Court's order, confirming 304 litigants whom I represented at that time. Please save me the burden of having to sign every retainer agreement, scan and email it out. In my 22 years of practice I have rarely signed a retainer agreement (and, when I did, it was for Russian clients my late Russian colleague prepared and handled). [/FONT]​[FONT=宋体][FONT=宋体]I expect to be filing 82 new cases today or tomorrow -- none of which is Chinese -- after which I will turn my attention to preparing the written arguments and the affidavits. So, if others are going to join, I hope that they do so soon because I have to select one person to represent applicants at each visa post involved. The fewer the litigants, the lower the likelihood of having a client with good facts。[/FONT]​[/FONT]

回复: 和律师的通信我们北京91的情况与香港91的不同，我们都已经S2补料，很多人CAIPS查询结果都审过了，就等发ME了，而香港还没开始审理呢。我们北京91的他打算怎么弄呢？

尽人事，听天命。Do something...07年7月 FN，等ME中。。。 超赞 赏 T tzhjqy 0$(VIP 0) 7392011-12-14#20 回复: 和律师的通信楼主辛苦了。我只是觉得律师说起诉的会先审理，这好像不应该是移民局的做事原则，一旦这样那就会有几万人去起诉的，这就会天下大乱的。我觉得最合理的解决方法应该是移民局同意每年会为不同政策的申请者提供一定比例的名额，使得71，626，227，91和以前的旧证同时进行，这是最重要的。我个人的己见，请谅解。其实我也很希望起诉成功，最起码给大家一个希望。
