Excerpt from our D Memorandum D2-2-1, Settlers’ Effects Tariff Item 9807.00.00, For the purpose of tariff item No. 9807.00.00, “settler” means any person who enters Canada with the intention of establishing, for the first time, a residence for a period of not less than 12 months, but does not include a person who enters Canada for the purpose of (a) employment for a period not exceeding 36 months; (b) studying at an educational institution; or (c) performing preclearance activities on behalf of the Government of the United States under the terms of the Agreement on Air Transport Preclearance between the Government of Canada and the Government of the United States of America, signed January 18, 2001. The detailed story is as following:-We got the Immigration Visa on Oct 14th, 2011 whose expiry date is Dec 8th, 2011. As it was very difficult for us to finish handling all the matters in that short period (one month and a half), we could not moving to Canada in 2011. So we had to land in Canada on Nov 5th, 2011 to be familiar with local’s life and flied back to China soon to accomplish our final job tasks at hand and then prepare the immigration move in 2012. As a result, we carried nothing but some clothes and were not able to complete a B4&B4a form “Goods to Follow” in advance and submit it to the officer at our first entry to Canada. Now during our preparing for settling in Canada, I found from your website that under customs legislation, Settlers mean all individuals who enter Canada with the intention of establishing, for the first time, a residence for a period of not less than 12 months. So we think at our first entry @ Nov 5th, 201 without the intention of remaining in Canada we are not considered Settlers to Canada. Therefore, when we enter Canada in 2012 with the intention of residing in Canada for a period of more than 1 year, can we submit the B4& B4a form “Goods to Follow” to you and enjoy import duty- and tax-free?
