The certificate of an independent Chartered Accountant appointed by, or acceptable to,the landlord to determine the amount will be conclusive and binding on the landlord and tenant. If the dispute is in connection with the amount of operating Costs,the determination of the Chartered Accountant need not be made before the date on which the lease year would have ended but for the exporation of the term. The costs of obtaining that certificate will be immediately due and payable by the tenant if the amount of money payable by the Tenant for the period,as established in the certificate,is not less than 95% of the amount claimed by the landlord.
