如最终用户没有按委托进口合同的约定付款，卖方应当积极主张或授权买方直接向最终用户索款；如买方按时收到最终用户款后迟延支付或拒不支付给卖方的，最终用户不承担责任，卖方可直接向买方追究违约责任。鉴于本合同是由卖方与最终用户直接商定，买方是受最终用户委托，作为最终用户的代理人,以自己的名义与卖方签订的,因而本合同直接约束卖方和最终用户。如因最终用户迟延履行或拒绝履行付款义务给卖方造成损失的，买方不承担责任，卖方可以直接向最终用户追究违约责任；如因卖方违约最终用户造成损失的，买方不承担责任，最终用户可直接或授权买方向卖方追究违约责任。

In case the end user failed in effecting payment per import agency contract,the Seller should take effective measures or
authorize the Buyer to request for payment from the end user.If the Buyer deferred or refused to pay the Sellers after
receipt of payment from the end user in due course,the end user should assume no responsibilities arising hereof while the
Seller could take the legal action for the breach of the obligations on the Buyer directly.

In light of the fact that this contract was negotiated and put into force by the Seller and the end user directly while the
Buyer just acts as the agency on hehalf of the end user to sign this contract with the Seller in it's own name,therefore,this
contract is binding on both the Seller and the end user.The Buyer should not be accoutable for the behaviours including,but not limited to,the losses caused by the end user's deferral or refusal to pay the Seller.The Seller could take the legal action
for the breach of the obligations on the end user directly.The buyer should assume no responsibilities for the losses on the
end user if the Seller breached it's obligation,the end user could take the legal action directly against the Seller or authorize
the buyer to do so, for the breach of the obligation by the Seller.
