一是进出口受阻、遭禁或恶意阻挠，二是出口港所在地的原产国或卸货港所在地的目的地国家以政府名义操作或实际操作、立法以限制进出口，以上两种情况中，不管是对进出口完全禁止还是部分禁止，这样的限制都应在双方合同中有所体现，若是合同或合同中的部分条款未能实现，在一定程度上应当相应去除。
