这次shipment 肯定会比LC上的晚蛮久，我申请客户改LC，可是客户说到时候接受不符点，这样会有问题吗？该如何解决这个问题呢，客户要是到时候直接付款少了5个点或10个点，我们万万承受不起的！

In case of late shipment, if our bank deciedes to aproach to the applicant for a waiver and subject to applicant's acceptance the followingpenalty conditions will be applied:
A late shipment between 1-10 days after latest date of shipment: 5 PCT disount will be deducted from the commercial invoice amount.
B late shipment between 11-20 days after latest date of shipment:10 PCT disount will be deducted from the commercial invoice amount.

最好是要求客户改证，这是万无一失的解决办法。
若客户坚持不改，且也确认会接受晚装船的不符点，建议让客出一份CONFIRMATION LETTER, 内容大致为客愿意接受该票货物晚装船，且会接受此不符点，然后签字盖章后发给你们。

你这个要改证了。信用证里都明确规定了晚开几天要扣多少百分比，可以接受不符点付款，但是该扣的还是会扣。

客户已经发邮件告知了会接受不符点哦。 只是我担心的是#3客户直接付款少付了钱，我们也是没办法。

问这样的问题，说明对信用证的定义都没有搞明白——信用证是开证行对受益人有条件的付款承诺，是开证行与受益人之间的、单独的单据买卖，即开证行是信用证的付款人，只要受益人交单相符，开证行才会保证付款。也就是说，受益人能够安全收款的条件是按照信用证的规定行事——在信用证规定的最迟装运日之前装运货物，并提交符合信用证规定的单据，否则，无论是迟于信用证规定的最迟装运期交货，还是提交了不符合信用证规定的单据，开证行都可以拒付——与开证申请人无关。所以，开证申请人接受不符点云云皆与信用证无关，即信用证是开证行对受益人付款，不是开证申请人对受益人付款。只有当开证行拒付之后，信用证作废，此时变为D/P托收，那么，开证申请人才可以说接受单据，也就是向开证行付款赎单——而D/P收款是没有保障的，即客户（原开证申请人）付款，发货人（原信用证的受益人）才能够收款，如果客户不付款不赎单，发货人则毫无办法！
况且，该信用证规定了迟交货物的罚款比例，也就是说，如果开证行接受单据，那么，肯定是要按照信用证规定的罚款比例扣款的。
所以，在不能够按时装运的情况下，必须修改信用证的最迟装运期和有效期，当然，交单时不能够有不符点，否则，开证行同样会拒付。

Goods are all ready for shipment. Therefore the shipment schedule is ok.
We are awared that you will accept discrepancies with the docs.Thank you for doing this.
But as you know,there is penalty terms in LC about late shipment. (in 47A article 9 as below).
You know that we had already provided our best discount for this LC order.So there will be great loss if our bank gets any penalty because of late shipment.
So we hope for your understanding. Please tell us your advice soon.

As there is late shipment,we kindly ask to amend LC as below.
1. to amend LC 44C into 130830. (latest shipment date)
2. to amend LC 31D into 130915 .(date and place of expiry)

我再次跟客户解释如下，希望客户可以尽快改证。
Even the applicant (MUDO ) agreed to accept discrapancies and not charge any penalty ,
the negotition bank will deduct the 5 PCT or 10PCT of amount directly when they pay us according to LC.
In this case, you pay the right amount of money, but our bank will get penalty as well.
So there is only way to avoid this , that is, to amend LC. I know this will bring you inconvenience but it is important to us.
