Except to the extent expressly stated otherwise in this Agreement and provided always that it has not acted fraudulently or with intentional misconduct, each party will not be liable (to the fullest extent permitted by applicable law) whether by way of indemnity or guarantee or by reason of any breach of contract, statutory duty or tort (including negligence) or any other legal principle for (a) any loss of profit , use, revenue, anticipated saving, product, bargain or opportunity or (b) any special indirect, consequential or punitive losses or damages客户发来的协议，，实在是搞不定啊。

就觉得你的条款挺怪异的， 你这里面好像少了一些合约的内容。

除了在本合约明确指出的行为需要承担相应的责任之外，只要不是有目的的进行欺诈，或者是故意的疏职，双方勿需对其他的行为负责（尽可能在法律允许的范围内）。
下列是需要负责的行为各种形式：
损失补偿，担保之形式，任何形式的合同爽约，法律责任，民事违法包含渎职，以及其他条款的 利益损失，利用之效能，收入，预期利润，产品，优惠，任何形式的见解的，后续的处罚损失。
