1、If either BUYER or SELLER fails, or is delayed wholly or in part, in carrying out any of its obligations under this Contract due to Force Majeure, except as otherwise expressly provided herein, the obligations of the entity giving such notice shall be suspended to the extent made necessary during the continuance of such Force Majeure or its effects; and the entity shall incur no liability by reason of its failure to perform the obligations so suspended, provided that the disabling effects of such Force Majeure shall be eliminated by the affected entity as soon as to the extent reasonably possible, further provided that settlement of labor disturbances shall be within the sole discretion of the affected Party.2. If such impediment shall have continued for a period of thirty (30) days
beyond the original shipping period for the quantity concerned, the Parties shall meet and discuss the desirability of canceling the shipments concerned or likely to be concerned and failing any contract regarding the same, the Party not impeded by the event of Force Majeure may cancel such non-shipped quantity by dispatching notice of such cancellation by telex or facsimile and confirmed by registered mail within fifteen (15) days after the termination of the period of thirty (30) days extension above referred to.
