2.notwithstanding the provisions of ucp600,in the event that we determine that the documents presented under this credit appear on their face not to be in compliance with the terms and conditions of this credit, and if we give notice of refusal of such documents presented, we shall hower ,at our absolute discretion, retain the right to approach the applicant for a waiver of the discrepancy （ies），subject to such waiver being acceptable to us. 首先要弄清楚，这段文字是开证行写的．
根据UCP500的规定，如果认定提交的单据与信用证上的条款不一致，我们有权拒绝接收，但是我方仍保有向申请人提出＂不符点免责＂要求的权利，但这种免责须经我方批准后方可生效．一旦获得免责，我们可能会直接把单据放给信用证申请人而不需通知交单人，即使之前有事先告知交单人我们会按照交单人的意思处理单据，但是如果在放单给申请人之前，没有收到交单人相反意思的书面指示，那么这种放单做法并不构成我方为按交单人意思处理单据的过失，在这种放单情况下，我方对受益人，议付行，交单人由此所带来的损失不承担任何责任．

ANY SUCH RELEASE PRIOR TO RECEIPT OF CONTRARY INSTRUCTIONS SHALL NOT CONSTITUTE A FAILURE ON OUR PART TO HOLD THE DOCUMENTS AT THE PRESENTER'S RISK AND DISPOSAL,AND WE WILL HAVE NO LIABILITY TO THE PRESENTER IN RESPECT OF ANY SUCH RELEASE.
根据UCP600第10条16CIIIB所述，如果我行给出通知，拒付该信用证，我行亦保留从开证申请方收取不符点费用的权利，另，若此不符点为我方接受，在我行未收到交单方提供的任何相关书面指示前，无须根据相关指示我行即可放单；在收到指示前放单责不在我方，我方无义务保留单证也无责任处理单证的错误之处。我行对交单方单证放单无任何责任。
