前期我发了一个贴,求助各位优化包装保函;虽说不用对卖方完全有利,至少不吃亏就行。客户的意思是,必须要我们体现托盘一旦有破损就需要我们赔偿的字样。
这不合情理,整个运输过程也不是我们可以控制的。
今天特地写了一大段文字给他们看,最终他们同意不加赔偿字样,就按照我们说的“出现问题通过友好协商解决”。
以下是写给客户的全文,名字用*代替
Dear *****,
as for the guarantee of pallet packing without top, we have some comments as follows:
1. We can have different ways to solve, other than paying certain cost.
2. If we are to bear the cost, the logistics company will be free of responsibility, which may cause improper unloading operations.
That's not fair to product factories.
3. Concerning the INCOTERMS 2010, FOB guarantees the safety of product and branded package before sail;
the risks will be transferred to other parties, maybe buyer, or insurance company (if the buyer has an insurance policy)
4. As the original letter template sent from you, it said "...proper load/unload";
proper load is our duty to make sure, however, the proper unloaded can't be guaranteed. You would not get a promise from any factory that the goods could be unloaded properly in destination port. That's the point in which the unfairness lies.
5. In addition to Clause 1, if we agreed to add the words
"... are ready to pay cost if pallet was broken because of poor quality ...", we have to pay certain amount, no matter how much, even the damage is due to violent operation of unloading by logistics company(or port operators).
So our suggestion is that you can confirm our last version which comes with words
"Both parties agree to strive to resolve all disputes arising from the damage which has serious impact on product performance, through friendly negotiations."
